1. DERECHO DE LA NAVEGACIÓN
1.Se pretende que el/la alumno/a sea capaz de comprender y resolver las cuestiones relacionadas con la legislación y normas marítimas que le permitan la identificación de la norma jurídica aplicable al caso concreto así como la previsión de las consecuencias jurídicas. Esta competencia general se concreta en las siguientes:
2.Demostrar conocimiento y comprensión de los conceptos y régimen jurídico de los accidentes de la navegación
3.Identificar las prescripciones legislativas en materia de protección del medio marino y seguridad de la vida humana en la mar, con el fin de establecer las obligaciones en la materia y el régimen de cumplimiento.
4.Delimitar obligaciones y responsabilidades profesionales derivadas de convenios internacionales y normas nacionales en supuestos de accidentes de la navegación
COMPETENCIA DEL MÓDULO:
Intensificación de la gestión, organización y normativa vigente aplicable a los buques.

Para aprobar la asignatura (bien siguiendo la evaluación continua bien siguiendo la final) hay que aprobar la parte de Derecho de la Navegación y la parte de Frases Normalizadas de la OMI.
DERECHO DE LA NAVEGACIÓN: 50 % de la NOTA FINAL DE LA ASIGNATURA
Sistema de evaluación continua:
50%: 2 pruebas parciales. Para aprobar la asignatura es preciso obtener una nota mínima de 5 sobre 10 en los exámenes parciales (pruebas escritas de desarrollar).
50%: trabajos individuales, en grupo, exposiciones en clase, casos prácticos...
Criterios de evaluación para las herramientas que se proponen en la evaluación continua.
A.- Criterios generales de evaluación de informes /trabajos escritos:
1.- Corrección en la expresión escrita: claridad y orden en las ideas/argumentos
2.- Utilización de fuentes adecuadas a la tarea encomendada
3.- Identificación de los problemas y realización de una calificación jurídica correcta y argumentada de aquellas relaciones/hechos del supuesto práctico.
4.- Adecuada elección y uso de la normativa aplicable
5.-Propuestas de resolución jurídicamente argumentadas
B.- Criterios generales de evaluación de tareas realizadas en sesiones presenciales trabajando en grupos reducidos, en común o de forma individual:
1.- Corrección en la expresión oral: claridad y orden en las ideas/argumentos
2.- Identificación de los problemas y realización de una calificación jurídica correcta y argumentada de aquellas relaciones/hechos del supuesto práctico.
3.- Adecuada utilización de argumentos para rebatir otros.
4.- Grado de participación en el debate.
5.- Capacidad de aportación al Grupo y actitud positiva en el mismo.
Sistema evaluación final: 100% examen ordinario
FRASES NORMALIZADAS DE OMI: 50 % DE LA NOTA FINAL DE LA ASIGNATURA
CONTINUOUS ASSESSMENT: Assessment will be based an oral presentation (15%) and a written test (35%).
Withdrawal from an Exam Call: Withdrawal from a call will be assessed as “no grade reported” [no presentado/a, ez aurkeztua]. All students can withdraw from a call until at least one month before the date of the end of the teaching schedule of the corresponding course. This withdrawal must be submitted in writing to the instructor responsible for the course.
Plagiarism will imply and automatic grade of zero (0) for any oral / written activity. Translating information from other languages into English and presenting it as one’s own work will be considered plagiarism. Reading directly from one’s notes when instructed not to is grounds for an automatic zero. Assignments must consist of original work.
FINAL ASSESSMENT: All students have the right to be evaluated according to the final evaluation procedure independently of whether or not they have participated in the continuous assessment module. In order to withdraw from the continuous assessment, they must write the instructor responsible for the course expressing their desire to do so. Students can withdraw within the first 9 weeks of the course, according to the academic calendar of their centre. Those students who withdraw from the continuous assessment system shall take a final exam covering the whole ‘Frases normalizadas de la OMI’ content (No grades from the Continuous assessment will be carried over). Withdrawal from an Exam Call: In the case of final assessment, not sitting the exam on the official date of the exam qualifies as an automatic withdrawal from the corresponding call.
